Terms and Conditions for Hunter by DS-Works Inflatable Boats

1. Introduction
​
These Terms and Conditions (“Terms”) govern the sale, use, and warranty of inflatable boats sold by Hunter by DS-Works (“Hunter by DS-Works,” “we,” “us,” or “our”) in Switzerland. By purchasing or using our inflatable boats, you (“you” or “the customer”) agree to be bound by these Terms.
Please read these Terms carefully, as they contain important information about your rights, obligations, and limitations regarding our products. If you do not agree with any of these Terms, do not purchase or use the products.

2. Product Use and Safety

Hunter by DS-Works inflatable boats are designed for recreational use in accordance with their specifications. It is the responsibility of the customer to ensure that the inflatable boat is used in compliance with all applicable safety regulations, local laws, and manufacturer guidelines.

Always follow the manufacturer’s instructions provided with the boat regarding setup, maintenance, and usage.

Ensure the boat is used only by individuals with appropriate skills and training.

Safety equipment, including life vests and appropriate emergency gear, should always be used in conjunction with the inflatable boat.​

3. Limitation of Liability

Hunter by DS-Works accepts no liability for any injuries, accidents, damage, or loss incurred during the use or misuse of our inflatable boats, including but not limited to damage to persons, property, the boat itself, or any third party.

We do not assume responsibility for any misuse, neglect, improper assembly, improper maintenance, or failure to follow safety guidelines.

We are not liable for damages caused by natural elements such as storms, high winds, or extreme weather conditions.

We are not liable for damage to any third-party property or persons during the use of the inflatable boats.

In no event shall Hunter by DS-Works, its employees, agents, or affiliates be liable for any direct, indirect, incidental, special, or consequential damages arising out of the use or inability to use the inflatable boats, even if advised of the possibility of such damages.

4. Warranty and Returns
​
Our inflatable boats come with a limited warranty that covers material PVC and seams under normal use conditions. The warranty period is 2 years from the date of purchase. The warranty does not cover damage resulting from:

Accidents, misuse, or neglect.

Damage caused by exposure to extreme conditions, including but not limited to excessive heat, cold, or prolonged exposure to sunlight.

Regular wear and tear or damage from improper storage.

All punctures are not covered by warranty.

To initiate a warranty claim, the customer must provide proof of purchase and a detailed description of the defect. Hunter by DS-Works reserves the right to inspect the returned product and determine if the warranty claim is valid.

Returns for products not covered by warranty (e.g., due to customer dissatisfaction) will be subject to a restocking fee 10 % and must be made within 14 days from the purchase date, with the product in its original condition and packaging. Shipping fees will not be refunded. Return shipping is the customer's responsibility.

5. Shipping and Delivery
​
Please contact us directly to organise the best shipping quote. Shipping rates are constantly depending on economic and geopolitical factors. Shipping costs are the responsibility of the customer unless otherwise specified. We will make reasonable efforts to ensure timely delivery; however, we do not guarantee delivery times and are not responsible for delays caused by third-party carriers or events beyond our control (e.g., weather, strikes, customs issues).

6. Customer Responsibilities
​
It is the customer’s responsibility to ensure that the inflatable boat is stored and maintained in a safe, dry, and clean location. Customers are advised to inspect the boat regularly for signs of wear, damage, or defects and to promptly address any issues to prevent further damage or accidents.

Inflate the boat only to the recommended pressure levels.

Regularly check for punctures or leaks and promptly repair them using appropriate materials.

7. Indemnification
​
The customer agrees to indemnify and hold harmless Hunter by DS-Works, its affiliates, employees, agents, and officers from any and all claims, liabilities, damages, losses, costs, or expenses arising out of or in connection with the use, maintenance, or storage of the inflatable boat.
This includes any claims arising from personal injury, property damage, or damage to third parties that result from the customer’s actions or negligence.

8. Modifications and Amendments
​
Hunter by DS-Works reserves the right to modify, amend, or update these Terms at any time. Any changes will be posted on our website, and it is the customer’s responsibility to review these Terms regularly. By continuing to use or purchase products from us after any changes to the Terms, the customer agrees to be bound by the updated Terms.

9. Governing Law and Jurisdiction
​
These Terms and any disputes arising out of or related to them shall be governed by and construed in accordance with the laws of Switzerland. Any disputes shall be resolved exclusively in the courts located in Geneva Switzerland, and the parties consent to the jurisdiction and venue of such courts.
